1. About these terms
These terms are an agreement between you and Michael Overton, trading as LumaReview in the United Kingdom. By creating an account or using the service, you agree to them. Contact us at support@lumareviews.co.
LumaReview is offered for business and professional use. You confirm that you are using it mainly for purposes connected with your trade, business, craft or profession and that you have authority to act for the business on the account.
2. The service
LumaReview lets a business configure its own SMTP account, send review requests, collect ratings and private feedback, and direct customers to its genuine Google review page. Features may evolve, but we will not materially remove paid functionality without reasonable notice unless security, law or a third-party service requires urgent action.
We do not promise that a customer will respond, leave a public review, choose a particular rating, or that a third-party platform will publish a review.
3. Accounts and security
You must provide accurate information, protect your password and recovery codes, restrict account access to authorised people and tell us promptly if you suspect misuse. Optional authenticator-app two-factor authentication and passkeys are available in account settings. You are responsible for activity performed through your account unless it results from our failure to use reasonable care.
4. Your customer communications
You are responsible for deciding who receives a review request and for having a valid lawful basis and any permission required to use that person’s name and email address. Only contact genuine customers following a real interaction. Do not use purchased lists, send spam, impersonate another organisation or upload information you are not entitled to use.
You must keep business details and sender information accurate. Your SMTP provider’s terms and sending limits also apply. LumaReview may limit or suspend sending that threatens deliverability, security, the platform or other people.
5. Honest reviews and platform rules
You must not use LumaReview to fabricate reviews, offer undisclosed incentives, threaten customers, selectively prevent customers from accessing a public review option, or otherwise manipulate ratings. You are responsible for complying with Google’s policies and the rules of any other review platform you link to.
Private feedback belongs to the relevant business account, but you must use it fairly, lawfully and respectfully.
6. Subscriptions and payment
Paid access is available on the monthly or annual plan displayed at checkout. Charges are taken in advance through Stripe and recur at the selected interval until cancelled. Any applicable taxes and the total payable are shown during checkout.
You can manage or cancel through the Stripe billing portal in your account. Cancellation stops future renewal and normally takes effect at the end of the paid billing period. Except where law requires otherwise or the service was materially defective, fees already paid are not refundable merely because the account was unused.
If payment fails, access to sending features may be restricted while Stripe retries payment or until the subscription is restored.
7. Your data and privacy
You retain responsibility for and rights in the business and customer data you submit. You instruct us to process it to provide, secure and support LumaReview. Our Privacy Policy explains how personal information is handled.
You should export or retain any records you need before closing an account. We may delete account data after termination, subject to reasonable backup cycles and legal retention requirements.
8. Intellectual property
LumaReview and its design, software, branding and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not copy, resell, reverse engineer, disrupt or attempt unauthorised access to the service except where applicable law expressly permits it.
You grant us only the rights needed to host, transmit and process your submitted material to provide the service.
9. Availability and third parties
We aim to keep LumaReview available and secure but cannot promise uninterrupted or error-free operation. Maintenance, internet failures, SMTP providers, Stripe, Google and hosting infrastructure are outside our complete control. We are not responsible for changes or outages in third-party services, though we will take reasonable steps to reduce disruption within our control.
10. Suspension and termination
You may stop using the service and cancel renewal at any time. We may suspend or terminate access where you materially breach these terms, create legal or security risk, fail to pay, misuse customer data or threaten service deliverability. Where practical, we will give notice and an opportunity to remedy the issue.
11. Liability
Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that, neither party is liable for indirect or consequential loss. We are not liable for lost profits, lost business, lost goodwill or lost data where that loss was not reasonably foreseeable. Our total liability arising from the service in any 12-month period is limited to the fees you paid for LumaReview during that period. These limits do not reduce any rights that applicable law says cannot be limited.
12. Changes
We may update these terms to reflect service, security or legal changes. We will publish the new version and provide reasonable notice of material changes. Continuing to use the service after the effective date means you accept the updated terms; if you do not agree, you may cancel before they take effect.
13. General
If part of these terms is unenforceable, the rest remains effective. A delay in enforcing a term is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a business reorganisation or sale while preserving your rights.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except where mandatory law gives you the right to bring a claim elsewhere.
